Transfer or issue of foreign securities: regulatory framework under FEMA sets conditions and controls for resident transactions.

Regulation of transfers and issues of foreign securities by Indian residents is implemented under the Foreign Exchange Management Act through regulations that prescribe conditions, permissions, reporting obligations and exchange control procedural requirements. The notification invokes statutory powers to empower the monetary authority to define permissible resident dealings in foreign securities and to issue directions, approvals and compliance obligations for cross-border acquisition, disposition or issuance of such securities.
