India Exempts Packaged Software from Partial Excise Duty under Section 4 of Central Excise Act 1944

The Government of India, through Notification No. 17/2010-CX dated February 27, 2010, exempts packaged or canned software from a portion of excise duty. This exemption applies to the value associated with the transfer of the right to use such software, as determined under section 4 of the Central Excise Act, 1944. The notification supersedes a previous notification, No. 22/2009, and requires the provider of the right to use the software to declare the consideration paid to the relevant excise authorities and be registered under section 69 of the Finance Act, 1994.
