India-US Tax Agreement Exempts International Shipping and Aviation Income from Double Taxation, Retroactive to 1987
The Double Taxation Avoidance Agreement between India and the United States, effective April 12, 1989, exempts income derived from the international operation of ships and aircraft from taxation in both countries. This reciprocal arrangement applies to Indian residents and corporations for U.S. taxes, and U.S. citizens and corporations for Indian taxes, provided certain ownership conditions are met. The agreement covers income from operations, rentals, and related activities, and amends previous agreements from 1976. It applies retroactively to taxable years starting January 1, 1987, and can be terminated by either government with written notice.
