SEBI Amends 2002 Regulations: Enquiry Officer Must Be SEBI Officer Above Assistant General Manager Rank for Penalty Procedures.
The Securities and Exchange Board of India (SEBI) has amended the 2002 regulations concerning the procedure for holding an enquiry by an Enquiry Officer and imposing penalties. Effective from the date of publication in the Official Gazette, the amendment redefines the term 'Enquiry Officer' to mean an Officer of SEBI, not below the rank of Assistant General Manager or Assistant Legal Advisor, appointed by the Chairman or a designated Member to conduct enquiries. This amendment follows previous modifications made in November and December 2003.
