Income Tax Can Attach Assets Under Anti-Benami Law Even if Actual Owner Unidentified, Rules Adjudicating Authority.
The Income Tax department can attach assets under the anti-benami law even if the actual owner is unidentified, according to a quasi-judicial body's ruling. The Adjudicating Authority under the Prohibition of Benami Property Transactions Act upheld a 2023 asset attachment order from the Lucknow unit. The case involved large land purchases with unaccounted cash by three realty groups in Lucknow. Five land parcels valued at over Rs 3.47 crore were attached as benami assets. The Authority confirmed the attachment of properties worth Rs 3.10 crore, identifying an office boy as the 'benamidar' and ordering further investigations into additional assets.
