HMIL was found to have enforced resale price maintenance on its dealers, restricting discount levels through a Discount Control Mechanism. Additionally, HMIL mandated the use of specific lubricants, penalizing dealers for using alternatives. These actions violated Sections 3(4)(e) and 3(4)(a) of the Competition Act, 2002. The penalty, calculated at 0.3% of HMIL's average relevant turnover over the past three years, focuses solely on motor vehicle sales revenue. A cease and desist order was also issued against HMIL.
