Government Updates Guidelines: Prosecution Limits Raised to Rs. 1 Crore for Customs and Excise Offences.
The government has revised the monetary limits and guidelines for prosecution under the Central Board of Excise and Customs (CBEC) for offences under the Customs Act, Central Excise Act, and Finance Act. The revised limits for tax evasion and misuse of input tax credit in Central Excise and Service Tax cases have increased to Rs. 1 crore. For Customs Act offences, the limits for trade goods mis-declaration and fraudulent drawback claims have also been raised to Rs. 1 crore. However, no lower limit applies for serious offences like smuggling of fake currency, arms, or endangered species. These changes aim to optimize resource use and focus on significant evasion cases.
