Customs Act Chapter XIV-A: Settlement Commission Offers Alternative Dispute Resolution for Importers and Exporters, Immunity Possible
Chapter XIV-A of the Customs Act, 1962, establishes the Settlement Commission as an alternative dispute resolution mechanism for assessees, allowing for case settlements without prolonged litigation. Applications can be filed by importers, exporters, or others before adjudication, provided they disclose full duty liability and meet specific conditions, such as a minimum additional duty amount of Rs. 3 lakhs. The Commission has exclusive jurisdiction over accepted applications, and its proceedings are deemed judicial. Orders must be issued within nine months, and applicants may be granted immunity from penalties if cooperating fully. The Commission can also provisionally attach property to protect revenue interests.
