Person with benchmark disability defined to include individuals meeting the statutory measurable threshold or certified by a certifying authority. Person with benchmark disability denotes a twofold statutory category: individuals who have not less than forty per cent. of a specified disability where that disability is not defined in measurable terms; and individuals with a specified disability defined in measurable terms when that condition is certified by the designated certifying authority.
