FEMA Act 1999: Compounding Authority Must Issue Order Within 180 Days of Application for Admitted Contraventions
Under the FEMA Act, 1999, the Compounding Authority is required to issue a compounding order within 180 days of receiving a compounding application, after providing the applicant an opportunity for a hearing. Applicants may choose to attend hearings personally or virtually, without legal representation, as compounding is voluntary and pertains to admitted contraventions. The order will detail the specific contraventions and relevant provisions of FEMA. Copies of the order are sent to both the applicant and the Adjudicating Authority. Summary information of orders issued after March 1, 2020, is available on the Reserve Bank's website.
