Advance Pricing Agreement Application Processed Under Rule 10K by DGIT for International Taxation Explained
An Advance Pricing Agreement (APA) application, under Rule 10K, is processed by the Directorate General of Income Tax (DGIT) for International Taxation. For unilateral applications, the DGIT assigns the application to an APA team, which negotiates with the applicant to reach a settlement. The agreed draft is then reviewed by the DGIT and forwarded to the Board. For bilateral and multilateral APAs, the competent authority sends the application to the DGIT for analysis and preparation of a draft Indian position paper, which is then forwarded to the competent authority of India for further action.
