Understanding Appellate Remedies in Customs Law: From Commissioner Appeals to CESTAT and Beyond
Appellate remedies in customs law provide individuals aggrieved by departmental adjudication the right to appeal. The initial appeal is made to the Commissioner (Appeal), followed by the Customs, Excise, and Service Tax Appellate Tribunal (CESTAT). If the original order is by the Commissioner of Customs, the first appeal is directly to CESTAT. Legal questions from CESTAT decisions may be referred to the High Court, and certain decisions on classification or valuation can be appealed to the Supreme Court.
