Customs must enforce prohibitions and restrictions under the Foreign Trade Policy and allied statutes, including environmental, wildlife and arms laws, and where goods breach those prohibitions they may be liable to confiscation under Sections 111(d) and 113(d) of the Customs Act, 1962; Customs as the border agency implements administrative Ministries' orders and must consider allied legislation when applying penal provisions.
