Claim on ARE-1 with out Export Bill

we are based in FSEZ, West Bengal. In 2007-2008 Asstment yr our One Supplier had suppliesd some Fabric to our Zone unit on the basis of ARE-1. Now the Supplier had informed us that they are not going to claim any DBK and ready to issue us the Disclaimer Certificate so that we may apply the DBK with Appropriate Authourity . All the Goods are entered at Zone on ARE-1. Is it possible for us to get the claim on the basis of ARE-1 with out Export Bill . have any notification regarding this , please let us know .
