Compensation for medical expenses requires assessing statutory basis and workplace connection before preparing defence against dismissal.
An employee seeks compensation for medical expenses after dismissal for poor performance, with treatment for an accident occurring outside service; advisers should identify the statutory basis of the claim, determine the law or forum invoked, apply State rules and relevant Industrial Disputes Act principles, obtain the full case history and factual particulars on employment and accident nexus, and prepare a defence focused on absence of workplace connection while consulting a labour law expert. (AI Summary)

Please refer State Laws in this regard and also be a avid reader of Labour Law Reporter for the purpose of enriching your knowledge in labour matters.

In the Industrial Dispute Act, 1947, read with TN State Rules, there are plethora of judgments either side on your query.

Please understand the matter that on which basis your employee had filed the suit for compensation, then, prepare your defence accordingly.

Also discuss this matter either with consultant or with an expert in this field.
