Service Tax

Mrityunjay jha

Sir,  my company  given online data market research services  to a USA based company & registered with STPI,on or before 01.07.12, that type of company exempt from service tax, that kind of company covered under new service tax  Act and libale of service tax .

please adviced to me what  i can do,  company turned not < 10lacs

STPI-registered firms exempt from service tax for 10 years; export services qualify under POPs rules. A company providing online data market research services to a U.S.-based client inquired about its service tax obligations. The company, registered under the Software Technology Parks of India (STPI) scheme before July 1, 2012, was concerned about its liability under the new service tax regulations, despite its turnover being less than 10 lakhs. The response clarified that units registered under the STPI scheme are exempt from service tax for a specified period, typically 10 years, and that their services qualify as export of services under the Place of Provision of Services (POPs) rules if not registered under STPI. There is no levy of service tax  if a unit is registered under the STPI scheme.  There must be a time period say for 10 years, service tax would be exempted under this scheme.

Further, your activities are falling under export of services under POPs, in the event if you were not registered under STPI scheme.
