Clarification on CENVAT Credit for Service Tax on Freight: Conditions for Charging and Claiming Credit Explained. A query was raised about availing CENVAT credit on service tax charged by a cargo company on freight. Responses highlighted that CENVAT credit on inward freight is possible, but the cargo company should not charge service tax if it is a Goods Transport Agency (GTA). Under the reverse charge mechanism, specified entities must pay the service tax in cash and then claim credit. If the cargo company is an end-to-end logistics provider, it may charge service tax, allowing the recipient to claim credit if eligible. The discussion clarifies the conditions under which service tax should be paid and credited. (AI Summary)
