Service tax Liability

MUNIRAJ SRINIVASAN

Dear Sir,

Arrears of rent received now whether service tax liability is applicable for old rate i e  10.3% or current rate 12.36% kindly suggest me

Service tax on arrears of rent depends on the point of taxation and the invoice date to determine applicable rate. Service tax on arrears of rent depends on whether the applicable rate is determined by the historical date the charges accrued or by the current date of receipt; the controlling factor is the point of taxation as evidenced by the invoice or billing date.
