Ashok Chopra

Respected Forum,

We are group of companies and develped common LOGO as design and artwork to be printed on Letter Heads, Envelops, Visiting Cards.  Bill has been received in EOU company.  Pls clarify

1.  Can we take credit of full amount of service tax in EOU Company and file refund under rule 5 of  CCR, 2004 or not ?

2  if the credit is permissible, whether proportionately?

pls advice

Companies Question Full Service Tax Credit for Group Logo; Rule 5 Cenvat Credit Rules 2004 in Focus A group of companies developed a common logo for use on stationery and received a bill in their Export Oriented Unit (EOU) company. They inquired whether they could claim the full service tax credit and file for a refund under rule 5 of the Cenvat Credit Rules (CCR), 2004, or if it should be proportionate. The response highlighted that according to FTP 2009-2014, EOUs can claim CENVAT credit on service tax paid. However, since the logo is used across the group, the department might object, suggesting it is not solely for EOU use. Proportionate allowance is not possible under the current rules. (AI Summary)
