Use of One Building by two Companies for Excisable goods

Pradeep Kaushik

Respected Sir,

We are an Exciseable goods manufecturing company and we are operating from Ground Floor of a commercial Building, which we have taken on Lease Rent.

Now some another Manufecturing Company wants to take the First Floor of the same building on Lease Rent. Is it possible, that we both companies can operate from the same premises. The entrance of the Ground Floor and First Floor are seperate.

Is there any obligation as per Excise Taxation. If Yes, please clarify in detail.

Best Regards.

Multiple Manufacturers Can Operate in One Facility with Separate Excise Registrations, SSI Exemption May Not Apply to Both A manufacturing company operating from the ground floor of a leased commercial building inquired if another company could lease the first floor for similar operations without violating excise regulations. Responses indicated that different areas within the same premises can be used by separate entities without issue, as excise registration is based on distinct operational areas. Legal precedents support the possibility of multiple manufacturers operating in one facility, each with separate registrations. However, while multiple registrations are permissible, the Small Scale Industry (SSI) exemption may not apply to both entities. (AI Summary)
