Legal Heir Can File Income Tax Returns for Deceased Spouse; Mrs. A Authorized to Sign for Mr. A. A query was raised regarding the filing of income tax returns for the fiscal years 2009-10 and 2010-11 for an individual, Mr. A, who passed away on October 1, 2010, without filing the return for 2009-10. The tax deducted at source (TDS) was deposited under Mr. A's PAN until September 2010. The response clarified that Mrs. A, as the legal heir, can file the income tax return on behalf of her deceased husband. The return should be prepared as usual and signed by Mrs. A. (AI Summary)
