Service Tax refund claim

velayutham panchatcharam

Sir, I am working in special economic zone. For service tax refund claim we are coming under notification 9/2009 and 15/2009. Our claim was rejected by Assistant Commissioner and in appeal also rejected due to time barred. Please give suggestion how to proceed further to get claim.

Service Tax Refund Claim Denied as Time-Barred Under Notifications 9/2009 & 15/2009; Consider as Cost. A query was raised regarding a service tax refund claim under notifications 9/2009 and 15/2009, which was rejected by the Assistant Commissioner and subsequently on appeal due to being time-barred. The individual sought advice on how to proceed further. The response suggested that since the claims are time-barred, they should be considered a cost. (AI Summary)

Being the claims are Time Bar, we think you must book this as a COST.
