Export Units Can Expand Production If NFE Is Met; Notify DGFT and Modify LOP for Duty Exemptions. A query was raised regarding the legal implications of exceeding the manufacturing capacity stated in a Letter of Permission (LOP) for an Export Oriented Unit (EOU). Two responses were provided. The first response clarified that there is no restriction under the Foreign Trade Policy (FTP) against increasing production capacity, as long as the minimum Net Foreign Exchange (NFE) is met. It was advised to inform the Directorate General of Foreign Trade (DGFT) about capacity enhancement. The second response agreed, advising modification of the LOP through the Development Commissioner to avoid issues with the Central Excise department when claiming duty exemptions. (AI Summary)
