Export-Oriented Companies Can't Import Cars Duty-Free; Benefits Limited to Manufacturing Capital Goods Per Trade Policy. A company, classified as a 100% export-oriented unit and a star house exporter, inquired about the possibility of importing a foreign car without paying import duty, leveraging their status. Two responses clarified that under the Foreign Trade Policy and relevant notifications, duty-free import benefits apply only to capital goods necessary for manufacturing or production, not for vehicles. Additionally, it was emphasized that even as a star house, the company cannot import a car without duty, referencing specific policy provisions and guidelines. (AI Summary)

Para 3.16 of the Foreign Trade Policy (FTP) read with notification no. 104/2009 Cus dated 14-09-2009 allowed import of capital goods against Duty Credit Scrips as part of Status Holder Incentive scheme. The benefit is allowed only for capital goods. The meaning of capital goods for the purpose of exemption is as follows, "9.12 "Capital Goods" means any plant, machinery, equipment or accessories required for manufacture or production, either directly or indirectly, of goods or for rendering services, including those required for replacement, modernisation, technological upgradation or expansion. It also includes packaging machinery and equipment, refractories for initial lining, refrigeration equipment, power generating sets, machine tools, catalysts for initial charge, equipment and instruments for testing, research and development, quality and pollution control. Capital goods may be for use in manufacturing, mining, agriculture, aquaculture, animal husbandry, floriculture, horticulture, pisciculture, poultry, sericulture and viticulture as well as for use in services sector."
