Passing of Cenvat credit

pardeep bisht

upto which stage of dealer we can pass on the cenvat credit

Cenvat Credit Transfer Allowed by First and Second Stage Dealers for Both Domestic and Imported Goods Under Excise Rules. A query was raised regarding the extent to which Cenvat credit can be passed on within the supply chain. The responses clarified that, according to central excise rules, Cenvat credit can be transferred by both the first and second stage dealers after the manufacturer for domestic goods, and similarly after the importer for imported goods. Essentially, Cenvat credit can be passed on by two dealers beyond the original source, whether it is the manufacturer or the importer. (AI Summary)

As per the scheme of central excise read with cenvat credit, in case of goods domestic goods cenvat credit can be passed by the first stage dealer and second stage dealer after the manufacturer. Similarly, in case of Import, the duty of excise can be passed on by the first stage dealer and second stage dealer after the importer. In other words cenvat credit can be passed by two dealers in addition to original source.
