further after two yrs Dept filed a writ against that order, my question is whether the writ is maintable as per monetary limit which is much more in the High court.

Exporter Wins Rebate Dispute; Department Challenges After 2 Years Despite Board's Circular on Monetary Limits An exporter of menthol received a show cause notice denying an export rebate, which was adjudicated against him by the Assistant Commissioner. The exporter appealed and won at the Commissioner level and again at the Revisionary Authority, with a disputed amount of 53 lakh. Two years later, the department filed a writ against the order. The exporter inquired about the writ's maintainability concerning the monetary limit in the High Court. A respondent clarified that monetary limits do not apply to certain issues as per a Board's circular, and the right of appeal is statutory. (AI Summary)
