CHANGE IN TRUSTEE - RE-REGISTRATION

NAMAN DOKANIA

Sir,

There is a change in trustee, in a trust registered under Section 12A. What documents we need to make for the same. Do we need to make any amendment deed or any supplementary deed or just a resolution with regards to the same. Please guide in this respect.

Procedure for Changing Trustee: Submit Change Report Form, Court Fee, and Documents Under Bombay Public Trusts Act. A query was raised regarding the procedure for changing a trustee in a trust registered under Section 12A. The inquirer asked if an amendment deed, supplementary deed, or resolution was required. The response advised that if the trust falls under the Bombay Public Trusts Act, a change report form must be submitted along with a 100 rupee court fee stamp and requisite documents, followed by a hearing and order. For income tax purposes, updating the trustee's name in the ITR forms should suffice. (AI Summary)
