Gst on real-estate prior to 01.04.19

NAMAN DOKANIA

How the tax on tdr will be calculated on the unbooked portion on the part of the builder share if the builder has opted for the old rate i.e. 12%??

GST on TDR: no exemption for unbooked builder share where JDA predates transition cutoff, tax payable on full portion. Where a builder elects the earlier GST regime because the joint development agreement predates the transition cutoff, no exemption applies and GST must be paid on the builder's entire share of TDR, including unbooked portions; this position is stated without accounting for ongoing litigation challenging GST on TDR. If it's 12% tax then it's a project where jda was entered before 1.4.19.

In such case no exemption available and gst to be paid on entire portion.

This is without considering that gst on the is under challenge
