Why we refer CGST rules ?

Balasubramanian Valleesan

we normally refer to CGST act & rules whenever we try to find a solution to the process to be followed and implemented. hope there are no separate rules for SGST. is it the fact that act & rules of CGST normally applies to SGST also. or SGST act and rules can be different as it is state based. require clarification though the query may appear a bit trivial in nature. thanks

Understanding Differences: Key Variations in Sections 3, 4, and 5 of CGST and State GST Laws Explained A user inquired about the applicability of Central Goods and Services Tax (CGST) rules to State Goods and Services Tax (SGST) and whether there are differences between them. A respondent clarified that while many provisions are similar, there are differences, such as in sections 3, 4, and 5 of the CGST Act compared to state laws. Another participant agreed with this view, and a third response suggested reviewing all applicable rules, including IGST, CGST, SGST, and UTGST, as states may introduce industry-friendly legislation. Dear Sir,

You must independently refer to the provisions of CGST Act, CGST Rules and SGST Act, SGST Rules. Majorly, the provisions are same but in some cases the provisions are different. For example, if you refer the provisions of section 3, 4 and 5 of CGST Act and any State GST law, you will notice some differences.

You may refer to State GST tab on this website and can practise referring to the provisions of both Acts.

Best Regards

In our view, for seeking clarification on your queries, you must go through the all applicable Rules, Regulations whether it is IGST,CGST, SGST or UTGST. Some times State for the purpose of promoting Industries in their State, introduces Industry friendly legislation.
