Security Services

karthick p

In our case, we have an invoice with the company name called ABC security services and they provided man power services and charging CGST & SGST. We have informed them that the GST will be paid us under RCM basis for security services but they have told us their company name is security services and they providing staffs for manpower not security services . Which one is correct? .

Thanks in advance

Experts Clarify GST Charges: Manpower Supply Services Not Subject to Reverse Charge; Forward Charge Correct for ABC Security Services A company named ABC Security Services provided manpower services and charged CGST and SGST. The inquirer believed GST should be paid under the Reverse Charge Mechanism (RCM) for security services. However, experts clarified that the nature of the service, not the company name, determines GST applicability. Manpower recruitment or supply services are not subject to RCM, unlike security services, which involve providing security personnel. Therefore, ABC's invoice charging GST directly is correct, as manpower supply falls under forward charge, where the supplier is responsible for GST payment. All experts agreed with this interpretation. (AI Summary)
