Input tax Credit

Bharat Cholleti

Dear sir,

I have not filed original return for the month of February and March 2019 till Dec 2019 the original return. Now my question is shall I eligible to take input tax in this situation?is section 16(4) is applicable. kindly clarify.

Taxpayer Denied Input Tax Credit for Late Filing; Section 16(4) of CGST Act Enforces Strict Time Limit A taxpayer inquired about eligibility for Input Tax Credit (ITC) after failing to file returns for February and March 2019 until December 2019. Respondents clarified that under Section 16(4) of the CGST Act, ITC cannot be claimed beyond the prescribed time limit. The discussion highlighted that the due date for claiming ITC is linked to the filing of the September return following the relevant financial year or the annual return, whichever is earlier. Despite differing views on the interpretation of ITC as a right or declaration, the consensus was that the time limit is binding and cannot be bypassed. (AI Summary)
