IGST CREDIT ON BILL OF ENTRY

POOJA BHOIR

Company A imports goods through Indian Post. IGST amount is shown in the receipt issued by Indian Post. Can I take credit of IGST paid Customs bill of entry. I request experts to give advice.

Company Seeks ITC on IGST for Imports via Indian Post; Validity Confirmed Under CGST Rules, 2017. Time-Bar Issue Raised. A company inquired about claiming input tax credit (ITC) on Integrated Goods and Services Tax (IGST) paid via a customs bill of entry for goods imported through Indian Post. An expert confirmed that under the CGST Rules, 2017, a bill of entry is a valid document for availing ITC. Another expert added that the receipt from Indian Post is also valid for ITC as it proves IGST payment. A further query was raised regarding the applicability of time-bar provisions for claiming ITC on IGST paid for imports made in October 2018, questioning if credit could be claimed after the filing deadline in September 2019. Madam,

As per rule 36 (1) (d) of CGST Rules, 2017 "a bill of entry or any similar document prescribed under the Customs Act, 1962 or rules made thereunder for the assessment of integrated tax on imports is an eligible document on the basis of which the input tax credit shall be availed by a registered person.

Receipt issued by Indian Post is also valid for taking ITC. You have paid IGST. You have proof of payment of IGST.

One query on above query - Wether the time barring provisions are not applicable in case of input credit of IGST on bill of entry. Means can we take input credit of IGST paid on imports done in Oct.18 in Nov..19 i.e. after last date of filing return of Sept.19
