Purchase of material from a foreign supplier but his place of production is in India

TN Rajendran

I'm buying a material from a foreigner (Dubai). The product that I'm purchasing from him is being manufactured in Mumbai only. (I'm from Chennai). Will it amount to Import of Goods and customs duty liable in the folloiwing cases:

1. My supplier do not have any place of business in India.

2. My supplier has a place of business in India.

Clarification on Customs Duty: No import duty for goods manufactured in India, only IGST applies unless goods enter from abroad. A participant from Chennai inquired about the customs duty implications when purchasing materials from a supplier based in Dubai, but manufactured in Mumbai. The query focused on whether this transaction constitutes an import if the supplier lacks or possesses a business presence in India. The response clarified that customs duty is applicable only if goods physically enter Indian territory from abroad. Otherwise, only the Integrated Goods and Services Tax (IGST) is required.
