import of electronic products for repair and return/re-export

ANAND SHARMA

our company wishes to import old and used defective set top boxes from abroad for repairs and these would be return/re-exported after repairs to the same vendor. We will only charge our repair charge. Kindly advise the formalities and the documentations required to complete the transaction. We require full details and approvals for the said transaction including the NOC, DUTY PAYMENT, AND DOCUMENTS REQUIRED FROM SUPPLIER.

Import policy classification controls repair-and-return imports; restricted goods need authorization, permitted imports face duties with drawback. Importation of old and used defective set top boxes for repair and return/re export depends on the goods' import policy classification (free, restricted or prohibited). Restricted imports require prior import authorization from the relevant ministry; prohibited imports are not permitted. Where import is allowed, applicable customs duties must be paid on import, and upon export after repair the exporter may claim duty drawback or similar reliefs, subject to procedural and documentary requirements for repair and return transactions. Please check the import policy of the old and used defective set top boxes i.e. whether import policy is free, restricted or prohibited. If restricted then you would need import authorization from respective Ministries and if prohibited then you cannot import the subject goods. If import is allowed subject to above points then you would have to pay the customs duties as applicable and after repairing, at the time of export you will get the Duty Drawback as applicable on subject goods.
