Can we pay excise now as wrong credit was taken in earlier period?

Harshada Prabhune

Can we pay excise now under GST senerioa as wrong credit was taken in earlier period?

Excise Duty Payment for Wrong Credit Under GST Allowed, ACES Site Open Until June 30, 2022, Interest Recommended A discussion on whether excise duty can be paid now for wrong credit taken in an earlier period under the GST regime. Participants agree that payment is possible, with some advising to include interest. It is noted that the ACES site remains open for such payments, and many pre-GST cases are still pending. The site will likely stay operational until at least June 30, 2022, allowing for show cause notices from the pre-GST period. The consensus supports the view that the government does not restrict tax payments from previous regimes. (AI Summary)

Yes you can pay along with interest

GAWESH NARULA on Feb 23, 2019

as per my view yes, you can pay , Govt never restrict to pay any tax either in old regime or current regime.

KASTURI SETHI on Feb 23, 2019

Otherwise also so many cases pertaining to pre-GST era are pending decision in the department and in various courts. Audit of the units of Central Excise and Service Tax is being conducted by the department. So the ACES site will continue to accept Govt. dues of Central Excise and Service Tax. The site will not be closed in near future.

DR.MARIAPPAN GOVINDARAJAN on Feb 23, 2019

It will open at least till 30.06.2022, the date upto show cause notice can be issued for Pre GST period invoking the extended period of limitation
