Service tax paid for Exempted service during Excise audit

mukesh pareek

Dear Experts,

Recently EA 2000 excise audit conducted for April-2017 to June-2017 period and auditors asked us to pay service tax on CFA import.

Accordingly we have paid service tax on our total CFA import but now we came to know that CFA import thorugh aircraft exempted from service tax.

Please advise how we can get our excess paid service tax refund ?

Company Seeks Service Tax Refund for Exempt CFA Imports; Experts Advise Claim Under Section 11B of Excise Act During an excise audit for April to June 2017, a company was asked to pay service tax on CFA imports. Later, it was discovered that CFA imports via aircraft are exempt from this tax. The company seeks advice on obtaining a refund for the excess payment. Experts suggest filing a refund claim under section 11B of the Excise Act through the ACES portal. They advise pursuing an appealable order and filing a refund claim, acknowledging it may be a lengthy process. Consideration of consultancy fees versus the refund amount is also recommended.
