Private Schools Exempt from GST on Fees per Notification No. 12/2017-CT; Refunds Not Applicable for Unregistered Payers. A discussion on a forum addressed whether private schools or coaching centers should charge GST on fees and the possibility of claiming a refund. One participant clarified that GST cannot be refunded if the payer is not registered under GST. Another highlighted that educational services provided by institutions are exempt from GST as per Notification No. 12/2017-CT, meaning private schools should not charge GST on fees. Consequently, the issue of refunds does not arise. Additional replies questioned the remittance of collected GST and noted that educational services are consumed and thus non-refundable. (AI Summary)

Dear sir,

As per entry no 66 of Notification No. 12/2017-CT (rate) dated 28.06.2018 services provided by an educational institution to its students, faculty and staff are exempt from the purview of GST. Further definition of term educational institution has been explained in aforesaid notification and the same reads as under:-

(y) “educational institution” means an institution providing services by way of,-

(i) pre-school education and education up to higher secondary school or equivalent;

(ii) education as a part of a curriculum for obtaining a qualification recognised by any law for the time being in force;

(iii) education as a part of an approved vocational education course;

Thus, keeping in view of above GST shall not be charged on the amount fees taken by the Private school from its students. When GST is not applicable, then question related to refund does not arises hereunder.
