credit of management consultancy service

manish kumar

Sir,

An Assessee has taken service tax credit of management consultancy service . Management consultanct service has provided by his sister concern. Can we allow such Cenvat credit ? Please explain in details.

Thanks

Cenvat Credit Allowed for Management Consultancy Services from Sister Concern Under Rule 2(I) of Credit Rules, 2004. An assessee inquired about the eligibility to claim Cenvat credit on service tax paid for management consultancy services provided by a sister concern. The responses confirmed that Cenvat credit is permissible if the service qualifies as an input service under Rule 2(I) of the Credit Rules, 2004, and the service tax is paid and utilized in providing taxable output services. The relationship with a sister concern does not impede the claim. The consensus among the respondents was that the credit is allowed, supported by relevant case law. (AI Summary)
