Late fee for GST returns waived for affected months; system errors caused automatic charges and refunds to cash ledger.
Automatic late fee computations were applied on the GST portal for delayed and nil returns, generating CGST and SGST daily charges. Taxpayers reported portal errors preventing submission of GSTR-3B, GSTR-1 and TRAN-1 and challenged automatic penalties imposed where technical failures obstructed filing. Administratively, late fee waivers were announced for affected months and any collected fees were to be restored by crediting taxpayers' Electronic Cash Ledgers, subject to formal notifications and reconciliation procedures. Late Fee is being charged for late filing of GST returns for the month of August in the September month return. Fee being charged is ₹ 200 per day of delay (Rs.100-CGST and ₹ 100-SGST). My understanding was that in a press release, it was notified that there wont be any penalties during the interim period. Still the penalties are being auto computed while filing the return.The levy is being done even for Nil returns. Would like to know if anybody else is facing difficulty due to this levy.

Since in the disruptive system penalty, late fee, interest shall not be levied. It is the obligation on the part of the Government to give the perfect system in the new tax management. But the Government is keen in collecting the tax within 20th of the following month and also collecting late fee/penalty and interest for late payment.

I am hopeful Govt. may waive penalty/late fee as was done for July return. Assessee is not at fault at all.

Dear Sir, We are facing same problem. I have written number of emails to GST helpdesk for errors while submitting GSTR-3B return for August 2017. No one has replied from department. And now system showing late fee 3200 + 3200 and i unable to file GSTR-3B return due to non execution of Offset liability. I am facing problems from beginning for GSTR-3B, GSTR-1 and TRAN-1 too due to GST system problems. If we unable to submit returns due to system errors, is it our error or mistake ? And system auto generated penalities without hearing assesses problems are just like Hitler Shahi.

Yesterday Govt. has waived late fee for August, 17 on account late filing GSTR 3B. Govt. will also waive late fee and penalty for all other returns because of failure of the system of Common Portal. Let us hope for.

This is a passing phase. Be relaxed. Wait for Feb.18 budget. All assessees will get sops from Govt. and balance sops can be expected before 2019 Lok Sabha elections. BJP Govt.will have to fulfill the promises assured in 2014. Whole GST is likely to be 'renovated' in Feb., 18. At present GST is hotch potch and nothing else. There is no doubt that GST was implemented in a hurry. BJP Govt. cannot blame Congress and other parties as Congress wanted to put cap of 18% of GST rate.(maximum). As our PM has said, "Congress is equal partner", so now BJP Govt. Has come to the level of saving its and passing the buck. We can hope more sops soon.

Yes. There was a news in the paper. Notification may be issued today. But it is confirmed news that penalty for August , 17 for GSTR 3B has been waived and those who have deposited penalty their

. amount will be refunded by way of credit entry into cash Electronic Ledger. So be tension free and look forward for more sops.
