DUTY DRAWBACK BACK -BRAND RATE OF FIXATION

KULDEEP SINGH

Dear Team,

We have taken CENVAT Credit on CVD AND SAD on inputs of imported material , we are claiming Duty drawback under Brand Rate of fixation ,now we have accumulated Credit in books ,can we reverse only SAD amount from books and claim SAD amount also in duty drawback along with BCD ,please confirm me notification saying that we can reverse SAD credit and afterwards claim SAD amount in duty drawback under brand rate of fixation ..

Thanks

CENVAT credit and duty drawback: plan import-time treatment to coordinate SAD reversal and brand-rate claims. The taxpayer availed CENVAT credit on CVD and SAD on imported inputs and asks whether only the SAD portion may be reversed from books and then claimed in duty drawback under the brand rate together with BCD. The reply advises that such coordination must be planned at the time of import. (AI Summary)
