Hire vehcile on lease

Samik Chaudhuri

Sir

Our logistics company wants to hire 6nos truck with agreement for monthly fixed amount from a Company. Now i would like to know whether this fixed amount attracts service tax or not? If attracts who will be liable to pay service tax? Please advice me at earliest.

With thanks

Samik Chaudhuri.

Service Tax Applies to Leasing Trucks Under Section 66E(f), Exemptions Possible for GTA Services Per Notification 25/12. A logistics company inquired about the applicability of service tax on leasing six trucks for a fixed monthly amount. An expert clarified that service tax is applicable under Section 66 E (f) and must be paid by the service provider, who collects it from the service receiver. Another expert noted that if the trucks are used for Goods Transport Agency (GTA) services, service tax may not apply. Further clarification indicated that service tax liability depends on the vehicle's use, referencing Notification No. 25/12, which exempts certain transport services from tax. The discussion concluded with agreement on these points. (AI Summary)
