Drawback scheme conversion may be permitted by administrative request despite EDI filing constraints preventing automatic change.
Conversion between drawback schemes after filing is constrained by the Customs EDI system, which prevents officers from electronically changing the scheme on a shipping bill once filed. Exporters may, however, submit a written request to the Customs Head to reclassify the shipping bill from the originally claimed scheme to another, providing reasons and justification for the change; such administrative requests may be considered at customs' discretion. Dear sir,

We are manufacturing of Chemical product and apply for Brand rate duty drawback scheme . Even Shipping bill also file at the time of export under drawback scheme .

But due to some circumstances we are not able to take Brand rate benefit , so we want to convert one scheme to another ( Brand rate to AIR rate ) .

Can this is possible ??? If yes please provide procedure guideline regarding this .

Dear Friend,

Under the present Customs EDI system, once the Shipping Bill is filed claiming the normal DBK, it is not possible for the officers to change the scheme and consider as Brand Rate of DBK.

However, there is nothing wrong in putting an effort of submitting a letter to the Customs Head requesting to change the Shipping Bill from Normal DBK to Brand Rate , explaining the reasons including justification that the normal DBK was less than the proportion prescribed in the Rules. There is a bright possibility to consider your request.
