DETERMINE OF ASSESSABLE VALUE IN DEALER INVOICE

SURYAKANT MITHBAVKAR

We have purchase excisable material from dealer and he is passed on excise duty to us. while showing assessable value in dealer invoice he is declared more value than selling price to us.

In such case any descripancy arrive to avail cenvat credit of the same.

Dealer Invoice Query Clarified: CENVAT Credit Must Match Amount Paid, Assessable Value Irrelevant for Credit Transfer. A query was raised regarding a dealer invoice where the assessable value declared was higher than the selling price, potentially affecting the availment of CENVAT credit. The response clarified that the dealer's responsibility is to pass on the correct amount of CENVAT credit, which should not exceed the amount paid. The assessable value on the invoice is not relevant for legal purposes concerning the passing of credit. Two other participants agreed with this explanation, affirming that the focus should be on the accurate transfer of credit, not the assessable value. (AI Summary)
