Contaienr Stuffing Permission

Dear sir

We had taken Container Stuffing Permission (One TIme) from Custom for our 3 Division in 2007

Now we had taken separate central excise registration w.e.f. 01.04.16 for our 3 division but IEC, VAT/ Sales Tax Registration/PAN no remain same as earlier.

Further while taking separate central excise registration there is no change in name, address of the Division etc.

Please confirm should we take separate container stuffing permission for all 3 division or our earlier permission which taken in 2007 will prevail as on today date.

Please revert with related rules & regulations.

Can you advice under which norms i.e. customs/excise we have to take separate container stuffing permission based on excise registration because our IEC.PAN, name of unit , Place of unit reamins unhanged i.e. same as in our earlier permission.

please check inital infomation you had furnished to dept for No objection certificate for stuffing permission. if details of all your three division is mention in requested lettter along with Annexure-A , than your permission is valid . if not there please follow the advise given by KASTURI SETHIji.

All details in our permission is in line but the difference is only Central Excise Registration i.e. w.e.f. 01.04.16 we had taken separate central excise registration.

VAT and Income Tax procedures have no link with Central Excise formalities. PAN may remain the same but last five digits must have changed in respect of all three divisions' registration certificates of CE.

As an abundant caution, it is better if we submit a letter to the department about your initial permission and the subsequent separate registrations for all the 3 divisions with a note that as there is no change in the Organization regarding other details except, for separate registration for each division, we would continue stuffing our export cargo under the permission given by you during 2007.

If the Department is having any objection for your using the consolidated permission, then they will advise you to take separate permissions. If no reaction from department, then you are safe from future complications if, any since you have already intimated situation and the facts to the department .
