Regarding for 60/61

Guest

hi i got the notice from income tax department to submit returns under form 60/61 under rule 12 of income tax 1962 act to submit the returns section 140.

Can you please help me out over these.

Thanks in advance for the help

Form 60 and 61 declarations require non-PAN or agricultural-only taxpayers to declare specified cash transactions; Rule 12 covers self-assessment. Form 60 and Form 61 are declaration forms, not tax returns: Form 60 is for persons without PAN/GIR making certain specified cash payments; Form 61 is for persons with only agricultural income and no other taxable income for the same specified transactions. Rule 12 relates to filing a return on a self-assessment basis; respondents should supply the particulars and facts in the department's notice to obtain further assistance. (AI Summary)

Form 60 and 61 are not income tax returns. Form 60 is the form of declaration to be filed by a person who does not have either a permanent account number or General Index Register No. and who makes payment in cash in respect of transaction specified in clauses (a) to (h) of Rule 114B. Form 61 is form of declaration to be filed by a person who has agricultural income is not in receipt of any other income chargeable to income tax in respect of transactions specified in clauses (a) to (h) of Rule 114B.

Rule 12 deals with filing of return on self assessment basis.

You have to indicate the details in the notice received from the Department and also the fact of the case. Then only help can be extended.
