Adding additional place of Trade

Hi,

I am running a retail business based on Bangalore, i have registered myself with VAT body and acquired a TIN. Now i want to move my office to a apartment near to my home for convenient purpose. I am ready to change the Utilities to Commercial and the owner of the apartment is ok with it, but the officials at VAT are not letting me transfer my office to the apartment saying they wont provide TIN for offices out of Apartments. Can anyone let me know if it is true? Cause i had known people running offices from Apartments? Need your help people. Thanks In Advance.

Business Owner Challenges VAT Officials' Denial of TIN for Apartment-Based Retail, Considers RTI and Legal Options A business owner in Bangalore seeks advice on relocating their retail business to an apartment for convenience. Despite having the apartment owner's consent and willingness to change utilities to commercial, VAT officials deny TIN registration for apartment-based offices. Respondents suggest addressing the issue with higher authorities, using the Right to Information Act (RTI) to obtain clarity, and applying for e-registration. They emphasize that the VAT department's stance may be incorrect, and the business owner should request written explanations from officials and explore legal provisions for registering additional business locations. Please ask them not to be so rigid as India has adopted the concept of ease of doing business. If lower authority don't understand then directly meet with the commissioner and convey the message of Our PM - Mr Modi in this regard.

You are at liberty to change your business premises.

If the department officials still argue, let them tell you in writing. For that you need to ask them through Right to Information Act. I strongly believe that the departmental officers are wrong.

For obtaining clarification you need to apply to your jurisdiction VAT Officer concerned.

Other wise you apply for e-registration. See the rule position:

Section 5. If the registered dealer has more than one place of business, he shall submit a further application in Form VAT 5a to the jurisdictional Registering Authority, along with Form VAT 1 if the additional place of business exists at the time of submission of application for registration and in other cases within ten days from the opening of additional place of business.

RTI will definitely help you.
