Selling of Used oil

Tejas Gandhi

Dear Sir,

We bought fresh oil from some vendor on excise invoice . we have taken cenvat credit on fresh oil and it is used in hydraulic system, Equipment & gear box for operation for equipment maintenance. After during this process generate used oil.

This generated used oil we want to sales to customer so that in invoice whether charged Excise duty or not ?

Kindly need your suggestion.

Excise Duty Applicable on Sale of Used Oil Purchased with Cenvat Credit Despite Being a Maintenance Byproduct A user inquired about the applicability of excise duty on the sale of used oil, which was initially purchased with cenvat credit and used for equipment maintenance. A respondent confirmed that excise duty should be charged on the transaction value of the used oil. The original poster sought clarification on why excise duty applies, as the used oil is a byproduct of maintenance activities rather than a manufacturing process. (AI Summary)
