Service tax credit availment

Guest

Dear Sir,

Whether availed service tax credit deniable on invoices having same service tax registration number but having different name of same entity,Please explain, thanks and regards.

Service tax credit may be denied where invoices show the same registration number but inconsistent names; documentary evidence can cure errors. Whether CENVAT credit may be denied where invoices show the same service tax registration number but different names: a registration number is unique and credit may be deniable for one invoice; printing or typographical errors are curable by submitting documentary evidence to the Deputy Commissioner of Service Tax; clarify and rectify inconsistencies early to avoid interest and penalty. Sir,

Two entities cannot have same service tax registration number. PAN may be same but not the registration number. If two invoices have the same registration number credit of input service tax is deniable in respect of one of them.

Dear Sandesh,

If it is a mistake due to some printing error at the end of printer, then, by submitting the documentary evidences to the Deputy Commissioner of Service Tax, CENVAT credit may be allowed as such mistakes are curable. Please check the material facts at your end.

I agree with both the expert. It is better to clarify at initial stage, if it is found in audit then interest penalty will be levied unnecessarily.
