Respected Sir,

As regarding above subject,one of my clients wants 2 change his constitution of business he wants convert a partnership firm into proprietory concern then what procedure we have to do to inform the excise department and what we have to do with the remaining cenvat and excisable stock.

Please reply.

Change of constitution: new proprietor must intimate excise department and may utilise existing CENVAT credit. Change of constitution from a partnership to a proprietorship must be intimated to the excise department and corrected (now online). The available CENVAT credit at the time of transfer may be utilised by the new proprietorship, with excisable stock to be accounted for under existing excise rules. (AI Summary)

Whenever there is change in the constitution the same has been intimated to the Department and corrected which can be done online now. The credit available at the time of transfer may be utilized, in my view, by the new business proprietary concern.
