LIABILITY OF TDS

MAYANK SUKHAR

Dear Sir,

Our company has business of Custom House Agency.

We are paying agency charges, logistics charges etc.to the parties.

Whether TDS is applicable on above payments under which section and how much rate ? If not give explanations.

Thanks

TDS applicability on agency and logistics payments depends on payment characterisation and statutory withholding conditions. Whether tax must be withheld at source on agency and logistics payments depends on the legal character of each payment, whether the payments meet statutory withholding conditions and thresholds, and whether any exemption applies; the payer must determine applicability, apply correct withholding treatment and maintain supporting records. TDS may be applicable on different payments subject to specific conditions laid down by law. it would be better to seek professional advice on the issue.
